Job Description and Duties

Under the administrative direction of the Chief Deputy to the Attorney General, and the administrative and legal direction of the Chief of Legal Affairs, and the Chief Assistant Attorney General, Division of Medi-Cal Fraud and Elder Abuse (DMFEA), the Criminal Senior Assistant Attorney General (SAAG) plans, organizes, and directs the work of the Criminal Prosecutions Section within the DMFEA of the Department of Justice. The DMFEA serves as the state’s federally mandated Medicaid Fraud Control Unit (MFCU) and enforces statewide authority in such matters through civil and criminal prosecutions.

The Criminal SAAG oversees all state and federal statutory criminal prosecutions for fraud by Medi-Cal providers and suppliers and those engaged in willful or intentional neglect or abuse of vulnerable or dependent adults. The Criminal SAAG ensures that investigative and prosecutorial resources are adequately and appropriately applied in each case, and works cohesively and cooperatively with the Civil SAAG and the Case Intake and Development Unit to accomplish this. The Criminal SAAG also works closely and collaboratively with the head of the Program Integrity Unit (PIU) of the State Department of Health and Human Services to ensure that the DMFEA is appropriately and timely treating matters referred to them by the PIU. The Criminal SAAG will further assist the Chief Assistant Attorney General in the responsibility of meeting the federal Performance Standards in its funded mission under the oversight by the U.S. Office of Inspector General (“OIG”) for Health and Human Services and develop policies to ensure on-going compliance with all federal rules.

In addition to the supervision of the Criminal Section's criminal prosecutorial matters and advice functions, the Criminal SAAG serves as a technical expert and primary legal advisor to the Attorney General, Chief Deputy to the Attorney General, Chief Assistant Attorney General, Division of Medi-Cal Fraud and Elder Abuse, and the Governor's Office on complex legal issues impacting California's Medi-Cal program and the People of California. The Criminal SAAG develops, recommends, and implements decisions on a variety of significant investigations and cases which could become criminal or civil prosecutions, and policy issues, including issues that will be decided in litigation before the state and federal Supreme Courts. The Criminal SAAG consults with the Chief Assistant Attorney General and the Civil Senior Assistant in the development and formulation of policy and program objectives, personnel management, and employee utilization; has principal responsibility for personnel management and employee utilization within the Section, and provides direction and guidance to subordinates through the supervising deputy structure. The Criminal SAAG may personally assist subordinates in complex litigation, reviews annual budget requests, and performs ongoing programmatic monitoring and reporting functions.

While the position’s location is specified as Sacramento County, the candidate selected will not be required to be headquartered in Sacramento, but will be expected to travel regularly to all of the Department’s main offices.

    Desirable Qualifications

    In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
    1. Broad and extensive experience in the practice of Medi-Cal fraud criminal investigation and prosecution. Ability to analyze complex legal problems and apply legal principles and precedents.  
    2. Demonstrated ability to direct criminal legal work in various areas of Medi-Cal fraud and elder abuse.  
    3. Demonstrated ability to provide assistance and advice to the Attorney General, Chief Deputy to the Attorney General, and Chief of Legal Affairs, as well as Chief Assistants and Senior Assistant Attorneys General, on policy development, and to direct the implementation of such policies in relation to Medi-Cal fraud and elder abuse. 
    4. Strong communication and interpersonal skills with a demonstrated ability to interact with multi-disciplinary professionals (e.g., department heads, court officials, and others) and maintain good relations with the public, the press, and various civic organizations. Ability to interact positively and effectively with subordinates, and other members of Attorney General’s Office at all levels.  
    5. Demonstrated leadership ability, planning, and supervisory skills.

    6. Knowledge of policies and operating practices of the Attorney General’s Office.

    Examination Information

    The exam will consist of a Statement of Qualifications screening process.  A departmental evaluation panel will review and score the Statements of Qualifications based on the Desirable Qualifications for the position, and the competitive nature of each candidate’s relevant knowledge, skills, and experience.
